General Terms & Conditions(AGB)

1. Scope of Application

1.1 These General Terms and Conditions (“T&Cs”) apply to all contracts concluded between FoxyMeals GmbH, FN 638176 w, Sebastian-Kneipp-Gasse 4/16, 1020 Vienna (“FoxyMeals”), and customers (“Customer”) relating to the preparation and delivery of meals ordered via the website or email.

1.2 Differing or supplementary customer terms do not apply unless FoxyMeals expressly agrees in writing.

1.3 By placing an order via the website or email, the Customer agrees to these T&Cs.

2. Conclusion of Contract

2.1 All product information on the website constitutes a non-binding invitation 
to order.

2.2 By submitting an order via the website or email, the Customer submits a binding offer to FoxyMeals.

2.3 The contract becomes effective only when FoxyMeals confirms the order 
by email.

2.4 Assignment or transfer of the contract or associated rights to third parties 
is excluded.

3. Delivery

3.1 Delivery takes place Monday – Friday between 10:30 and 13:00, excluding Austrian public holidays.

3.2 Delivery is available only within defined delivery zones in Vienna.  Requests to change delivery addresses may be accepted but are not guaranteed.

3.3 If the Customer is unavailable, FoxyMeals may leave the delivery at the agreed drop-off location at the Customer’s risk.

3.4 Meals are delivered in reusable containers inside a cooler bag. A deposit of €30 applies.

3.5 Containers and cooler bags must be returned on the next delivery day. Missing items incur replacement charges:

  • €15 per cooler bag
  • €5 per container

3.6 On the final delivery day, Recup containers will be used. Deposits are refunded directly by Recup. Any remaining deposit owed by FoxyMeals will be refunded via bank transfer.

4. Prices, Payment & Indexation

4.1 All prices are stated in euros (€), include VAT and delivery.

4.2 Payments are processed securely via Mollie. Accepted methods:

  • Credit card (Visa, Mastercard, Amex)
  • PayPal
  • Apple Pay / Google Pay
  • SEPA bank transfer
  • EPS
  • SOFORT

4.3 The total amount is charged immediately after order confirmation.

4.4 Subscription prices are value-protected and adjusted according to the Consumer Price Index 2015 (base year 2015) published by Statistics Austria:

  • Fluctuations of ± 2% are ignored.
  • Once exceeded, the new index value forms the basis for recalculation.
  • Adjusted values are rounded to the nearest €0.10.

5. Test Week (1-Week Trial)

5.1 Customers begin with a one-week paid test period (“Test Week”) at the standard weekly rate for the selected calorie plan.

5.2 The Customer may cancel the contract in writing or by email to madelein.vanwyk@foxymeals.com no later than the day after the final delivery of the Test Week.

5.3 If cancellation is received on time, the contract ends after the Test Week with no further charges.

5.4 If no cancellation is received, the contract automatically continues for the minimum subscription period defined in Section 6.

6. Duration and Termination (Online Version)

6.1 After the Test Week, the contract continues for a minimum term of 3 months.

6.2 Ordinary cancellation during the 3-month minimum term is not permitted.

6.3 After the minimum term, the contract renews monthly and may be terminated at the end of each month with 14 days’ notice.

6.4 In all cases, termination must be sent in writing or by email.

6.5 Once a subscription period has begun, cancellations or refunds are not possible unless FoxyMeals fails to deliver for reasons within its control.

6.6 FoxyMeals may terminate the contract with immediate effect if:

  • the Customer is in payment default and fails to pay within 14 days of written reminder;
  • the Customer repeatedly fails to accept deliveries or breaches container return obligations; or
  • the Customer behaves abusively towards staff or publishes false, defamatory, or unlawful statements harmful to the business.

7. Right of Withdrawal and Fresh Food Exception

7.1 As the meals are fresh food items, no right of withdrawal applies under §18(1) Z 4 FAGG.

7.2 Cancellations of future deliveries are only possible according to Sections 5 and 6.

7.3 Quality complaints can be sent to madelein.vanwyk@foxymeals.com.

8. Liability and Nutritional Information

8.1 FoxyMeals is liable only for intent or gross negligence.

8.2 Meals are prepared in shared facilities; therefore, FoxyMeals cannot guarantee the absence of allergen traces.

8.3 Stated calorie and nutritional values are calculated averages and may vary by ± 15%.

8.4 Liability for slight negligence, indirect damages, or consequential loss is excluded where legally permitted.

8.5 Statutory consumer rights (KSchG) remain unaffected.

8.6 FoxyMeals may seek legal remedies for demonstrably false or defamatory statements pursuant to §§111 ff StGB and §1330 ABGB.

9. Data Protection

9.1 Personal data is processed exclusively for contract fulfilment in accordance with GDPR.

9.2 Further details are available in the Privacy Policy.

10. Customer Obligations

10.1 Customers must promptly notify FoxyMeals of changes to personal data (name, address, allergies, payment details, delivery instructions).

11. Final Provisions

11.1 Austrian law applies.

11.2 Place of performance: Vienna.

11.3 For Customers who are not consumers under the KSchG, Vienna courts have exclusive jurisdiction.

11.4 If any clause becomes invalid, the remaining provisions remain unaffected.
